§1. General Provisions

These Terms and Conditions set forth the rules for using the bagmaextreme.pl website and the terms for the provision of tourism and recreational services, as well as equipment rentals.
The owner of the website and service provider is: BAGMA EXTREME Maciej Gębala, Osiedle Dwudziestolecia 4A, apt. 1, 34-460 Szczawnica, Tax ID: 7352479293.
You do not need to create an account or log in to use the website.

You can book activities, attractions, and equipment (including water sports equipment) using the interactive calendar available on the website.
To successfully make a reservation and secure a date on the calendar, you must pay the reservation fee.
The agreement is considered concluded once the reservation fee has been credited to the Organizer's account.

A deposit of 50.00 PLN is required to confirm your reservation.
Under the law, this fee constitutes a deposit toward the provision of the service.
If the Customer cancels the service or fails to show up at the scheduled time, the fee of 50.00 PLN is non-refundable and covers operational costs and the reservation fee.
The remaining portion of the service fee (if applicable) is paid in accordance with the price list prior to the start of the activity.

The customer renting the equipment bears full financial responsibility for the property entrusted to them (including inflatable boats, kayaks, life jackets, helmets, mountaineering equipment, and other items) from the moment it is handed over until it is returned.
The equipment must be returned in the same condition as when received. Normal signs of wear and tear resulting from regular use are acceptable.
In the event of loss, theft, or damage to the equipment caused by the user, the Customer is required to cover the costs of repair or purchase a new unit based on current market prices.
The equipment must be used only for its intended purpose.

Participants in the activities are required to strictly follow the instructions of the instructors, guides, and BAGMA EXTREME staff.
It is strictly prohibited to participate in activities while under the influence of alcohol, narcotics, or other substances with similar effects.
The organizer reserves the right to refuse service (without refunding the deposit) to any person whose condition indicates the use of the aforementioned substances or whose behavior poses a threat to themselves or other participants.

If the Organizer cancels the event (e.g., due to extremely bad weather conditions that pose a safety risk or due to force majeure), the reservation fee (50 PLN) will be fully refunded to the Customer or, with the Customer’s consent, the reservation will be rescheduled for another date.
In matters not covered by these Terms and Conditions, the relevant provisions of the Civil Code shall apply.
